– Hereinafter referred to as Nathalie Schultes –

  • 1 General information/scope of application

(1)  These General Terms and Conditions of Nathalie Schultes apply to all contracts for the provision of services concluded by a consumer or company owner (hereinafter „Customer“) with Nathalie Schultes for services described by Nathalie Schultes on her website. Insofar as the Customer is a company owner, they also apply to all future services or offers to the Customer, even if they are not agreed on separately again.

(2) Terms and conditions of the Customer or third parties do not apply, even if Nathalie Schultes does not object to their validity separately in individual cases. Even if Nathalie Schultes makes reference to a letter that contains or refers to the terms and conditions of the Customer or a third party, this does not constitute consent to the validity of those terms and conditions.

(3) A consumer within the meaning of these GTCs is any natural person who enters into a legal transaction for purposes that can largely neither be attributed to their commercial nor independent capacity. A company owner within the meaning of these GTCs is a natural person, legal entity or an incorporated partnership that acts in a commercial or independent professional capacity when concluding a legal transaction.

  • 2 Regulations and information on the conclusion of the contract

(1) General information

All offers by Nathalie Schultes merely constitute a non-binding call for the Customer to submit offers.

(2) Technical steps resulting in the conclusion of the contract and finalization of the purchase contract

The customer can submit the offer via the online order or contact form integrated into Nathalie Schultes‘ website. After selecting services and making the necessary entries, the Customer submits a legally binding contract offer for the selected services by clicking on the button that concludes the ordering process.

Nathalie Schultes can accept the Customer’s offer within seven days. The offer shall be accepted by Nathalie Schultes:

– by separate order confirmation, whereby receipt of the order confirmation by the Customer is decisive, or

– if Nathalie Schultes commences performing the service at the request of the Customer and notifies the Customer of this, or

– if Nathalie Schultes asks the Customer for payment.

If there are several alternatives, the one that occurs first is decisive.

If Nathalie Schultes does not accept the Customer’s offer within the aforementioned period, this is deemed to be a rejection of the offer, with the result that the Customer is no longer bound by their declaration of intent.

The contract is concluded upon acceptance.

(3) Saving and access to the contract text

Nathalie Schultes shall save the contract text and send the Customer the order data and contractual conditions by e-mail. Nathalie Schultes shall thereby provide the Customer with the opportunity to access the contractual provisions at the conclusion of the contract and save them in a reproducible form. Access to the contract texts saved by Nathalie Schultes is only possible for registered customers via the customer account, with the exception of freely accessible GTCs.

(4) Detection and correction of input errors

The customer can correct input errors by clicking the „back“ button or the usual keyboard and mouse functions. This is possible until the button that completes the order process is clicked.

(5) Languages available

The contract language is German.

  • 3 Prices and payment conditions

(1) The prices valid at the time of the order shall apply. In the event of an order from abroad, it cannot be ruled out that Nathalie Schultes‘ bank or country will charge unknown costs or taxes for the payment, such as processing fees. These are not costs that are paid or invoiced through Nathalie Schultes.

(2) Nathalie Schultes accepts all payment methods indicated on the website. The total price is payable according to the selected payment method.

(3) Nathalie Schultes is entitled to carry out deliveries or services for company owners only against advance payment or collateral.

  • 4 Right of withdrawal

(1) The right of withdrawal does not exist if the Customer acts in their commercial or independent professional capacity and thus as a company owner within the meaning of § 14 of the German Civil Code (BGB) when concluding the contract.

(2) Furthermore, the right of withdrawal does not apply to contracts with consumers who do not belong to a member state of the European Union at the time of concluding the contract and whose sole residence and delivery address are outside the European Union at the time of concluding the contract.

(3) The right of withdrawal expires prematurely if the Customer has expressly agreed to Nathalie Schultes beginning with the execution of the contract before the expiry of the withdrawal period, and the Customer confirms that they lose their right of withdrawal with the beginning of the contract’s execution.

  • 5 Alternative dispute resolution

(1) The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr.

This platform serves as an access point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.

(2) Nathalie Schultes is neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

  • 6 Final provisions 

(1) In the event that one provision of these general terms and conditions should be invalid, the validity of the other provisions shall not be affected. This applies in particular to the contract already concluded. Invalid clauses shall be replaced by statutory regulations. Other conditions apply only if adhering to the contract in this case poses an unreasonable hardship for a contracting party. Then the contract as a whole is invalid.

(2) With regard to all legal relationships arising from this contractual relationship, the contracting parties agree to apply the law of the Federal Republic of Germany with exclusion of the UN Convention on Contracts for the International Sale of Goods, unless this would deprive the consumer of the protection granted to them by the mandatory provisions of the country in which they habitually reside. In the latter case, the law of the country in which the consumer habitually resides shall apply.
